I was given a ticket for speeding of which I do not believe I was...
What really happened was that I was traveling with 5 cars, 1 in front , one behind and 2 to my side. We had been stopped at the light in Sidney 3 km away from the ferry and all had been traveling at the same speed into the terminal.
There were 3 cars with roof racks (myself included). One of the cars at the end of the highway towards the ferry merged over 2 lanes to get to the passenger off ramp they cut right in front of other cars and the police van but the van was parked in the lower section of the highway, so she (officer) did not pursue the van.
As we entered the terminal it was under construction, all the lines were either dotted (temporary) or not even there. As we approached the terminal the car to my right started to merge into my lane as the lanes swerved right but were not properly marked. I looked over my shoulder and moved out of the way of the car across to the far left lane.
I purchased my ticket for the ferry.
As I parked in my lane I saw a van coming down with its lights on.
The officer came over and said "WHERE DID YOU LEARN TO DRIVE." She then got my license went off and came back. She said she was going to give me a driving without undue care and attention but I would loose my license under the new laws so she would give me a speeding ticket.
At that point I asked "Was I speeding?" knowing that we had not been speeding since we had ample time to make the ferry and I was with a group of cars traveling at the same speeds.
She mentioned something about me speeding then said that "The car in front of you was consistently going 5km/h faster."
I then said "So I why am I being pulled over?"
She then mentioned again that the car in front of me was 5km/h faster than I.
At that point I looked at my friend and replied back "So they were speeding not me."
She then said "Oh no I mean you were going 5km/h faster than the car in front of you."
This is why I call BS to this whole ticket and why I am going to court.
There were 3 cars with roof racks. One merged across 2 lanes of traffic, over the white line up onto the passenger lane cutting off other cars heading to the passenger section. Another almost ran into me as I moved to the far lane to avoid it.
In the end it takes her over 3 minutes to come and pull ME over to give me a ticket which she changes to a speeding ticket.
I am still trying to figure out how best to explain this in court as its coming up soon. I honestly feel that I was not the one who should get the ticket but the one the cop spotted in the terminal and pulled me over.
Also traveling CONSISTANTLY 5km/h faster than the car in front of me means that if I was following a car at a distance of 2.5 car lengths I would have ran into that car within 6 seconds or 130 meters. Of which I had been following the car infront of me for over 3 km's since the red light at the last intersection before the ferry terminal.
Can I prove this and then somehow use it to show reasonable doubt?
