In relation to the criminal charge for reckless driving that Aaron and I received in Washington State in July.
The lawyer thinks we have a really good case of winning in court. We would however face a jury of 6 people which carries its risks and we'd have to pay additional legal fees on top of the retainer we have paid. It has not been cheap nor would it be cheap if we go to court. Even if we were to win in court we could not seek to have our legal expenses reimbursed.
The lawyer was talking to the prosecutor about reducing the charge and the prosecutor offered negligent driving which is not a criminal charge, I do not know what fine would have come with that but I imagine it also would not be cheap.
The lawyer rejected this option as insufficient given the strength of our case. The prosecutor came back with an ordinary speeding ticket and a fine of $113. It pisses me off because that's what I initially asked the cop for knowing we didn't deserve a criminal charge and wanting to avoid a costly legal bill. My sense is the prosecutor knows there's no case but they have no reason to completely drop the charge because they can still ask for a fine knowing we'd pay it because it's cheaper than going to court.
While I'm still pissed about the whole affair, I am taking the ticket simply because it's cheaper. Paying a few more thousand dollars for principle alone is a fool's errand.
Let this be a reminder to anyone riding in Washington State, the cops can hold Canadians over a barrel by abusing their powers and handing out reckless driving charges because they know Canadians will pay a lot of money to avoid a Criminal charge or else be barred entry into the US.
