Should I get a lawyer?
Hi I just need to vent for a second so bare with me.
I have been employed at a taekwon-do school for the past 6 months where I was the program director meaning I was in charge of the phone, finances, all the renewals and conference basically eveything but teach and today I was fired!! Why? I have no idea. My boss wanted me there for a year when I was hired (meaning I would be there till the end of july) and I was going to be given benefits after 3 months.. which he wont give me. So yeah to make a long story short he fired me today and I have no idea why. I think he really fired me so his girlfriend (who isnt able to do her job anymore cause she was a maid and her back is toast from a recent car accident) could take over she has been coming in often in the past few weeks to "volunteer" around the school. SO I think he got me to train her and then fired me so he could hire her. Nice eh? Any ideas?

Ummm haha thanks but I dont think I could do that. All the instructors are black belts and my boss in a 4th degree and me.. haha I dont know any taekwon-do moves. I am just so pissed I just want to tell everyone that calls about our school that he is an ass who only cares about money and not his students or his employees. Honestly, once they are signed into a contract, if they have a problem he wont talk to them, he makes me deal with it. Moron I should sue him. I think Mr 500,000 a year (at least!) could use the reality check that its not all about cash.

yes, get a lawyer. There are laws that say you cant fire someone that have been employed longer than 3 months without at least 3 written warnings (or something similar to that)... so I've heard.
Definitely get a lawyer, but contact labor relations first and find out what your rights are. If you have everything in writing, as far as the promise for benefits after 3 months and that you'd be employed there for a year will give you the upper hand, but if it's not in writing, it's your word against his and he better have a damn good reason for firing you, otherwise he owes you two weeks pay!

Really? Hmm interesting because before this I had no idea. I was getting tons of people enrolled I was hitting the 40k a month target for revenue and everything so yeah its kind of funny that as soon as his girl gets in a car accident he decides that I am not a good employee anymore. He also said it was cause I MIGHT be moving in September or January but like I said I was only supposed to stay there till August so that has no relevence does it and about the benefits?? Thats bullshit! Hehe sorry I am still alittle bitter this just happend at noon and I am at work till 7. He wants me to work for another week.. do I have to?
I know he has a few things against him from a former employee at the labor board so that might help me. God what an ass.
Also I had to work overtime and not get paid, I never got any breaks and if I was sick (with a doctors note) I would get in shit.. nice eh?

If you are being fired without cause, you get either notice or severance pay. The amount depends on how long you have been working there. After six months, you might get one or two weeks notice, or the equivalent in severance pay.

Look up "BC Labour Relations" in the phone book. They are downtown by the courts.
Tell them what happened. They will at least get you any back pay or holiday pay owing. They don't fuck around. Employers must pay you or Labour Relations breaks their balls.
I worked for this dink for a few years who bought out the bakery I worked at since 1993 (when I was a baker). I just went to labour relations and 2 weeks later they had a cheque for me. LOL. Fucker. Oh... don't ever buy anything from La Baguette on Granville Island or Lonsdale Quay. They even import people from Africa and the Orient and make them work as slaves.
To get fired on the spot without a reason the employer has to pay you 2wks pay I believe. Labour relations will help you with that. I don't think you need a lawyer...yet.

Hell No! Are you sure he's firing you?? 'Cuz if he wants you to work for another week, I would assume he's laying you off. Don't leave without two weeks pay, or at least UI though, he can't just leave you without income, unless he has a really good reason. Here's some legal info for you.

If an employee is terminated by their employer they are elegible for compenstation based on their length of service calculated on the following formula:
after 3 months' consecutive employment, 1 week's pay
after 1 year, 2 week's pay
after 3 years, 3 week's pay, plus 1 week's pay for each additional year of employment to a maximum of 8 years.
If An Employee Is Fired
An employee must be paid in full within 48 hours after being fired or terminated. If an employee resigns or quits, he or she must be paid in full within 6 days. If an employee cannot be located, the employer must pay the wages to the Branch within 60 days and the Branch holds the money in trust for the employee.

Yeah he said "work out the rest of the week" and that was about it. He is firing me. seriously I think he is bringing in his girlfriend because she has been coming to help me out around the school and has been really interested in stuff that she shouldnt be if she is just "killing time till her back heals to go back to her other job" like learning everything from an intro call to doing all the finances for their contract and shit.
I dont know this is bullshit. He has always been an ass.
So I shouldnt be working right now? I should not come back tomorrow.. haha if I dont show up, whats he gonna do.. fire me?
Is there anything I should be trying to gather in case I do decide to sue him? I have the school reports from this month and last month saying I was right up where the standards are as far as enrolling people and everything like that. God I am so pissed... I didnt see it coming!

He has to give a legitimate reason for letting you go. You can't just lay somebody off if you feel like it. Being replaced by a relative or gf, etc isn't enough justification.
That happened to me with my uncle many years ago. His son-in-law lost his job so guess who took my job. Bastard. I needed the change anyhow after working there 7 years and my aunt was/is a complete phsyco-bitch. Everything turned out for the better as I got paid way more in my new job and was introduced to living on the North Shore which is great. Life goes on.
Just watch out for E.I., they really screwed me the last and only time I was on E.I. Don't be honest if you want to start your own business. Make sure you keep records of your job searches, etc. They can request all the money back that they paid out. As well, it takes like 4-5wks to get your first E.I. cheque and all your holiday pay is deducted off it, so it's basically peanuts. If I hadn't of been married I would have been broke in the gutter. E.I. is a joke. We'd all be better off if we put money aside every month off our paycheque into our own E.I. account.
Keep any records of your work there. It's also better to be layed off than fired as far as your resume goes. Ask the ahole what you did to deserve being "let go". Then try to negotiate a lay-off instead of a firing.
Thanks. Yeah I know all about EI from another time. It took forever for me to get paid but when I did it was like chi-ching hehe. But that went all the paying off my debts but still.
