Went to court Monday on a speeding charge (car).
For a couple of the cases before mine, a different cop than the one that was present at the time of the offense was there to ask for an adjournment of the case. The two people, both poor English speakers, agreed to an adjournment. Reason given, the arresting officer was 'with child' and was sick.
The Justice asked the defendants if they agreed to the adjournment. Both said yes.
Now, if these were my cases - could I have asked for the case to be thrown out? Does the arresting officer not have to be present for the case to go through? My argument would have been that since she is 'with child', what guarantee would I have that for the next trial she would be present given her 'sickly' state?
Weirdly enough, my case officer didn't show, but phoned into court at the last second and withdrew the charge. So WIN for me.
