Ok, here is a hypothetical situation:
If I am issued a ticket for consuming alcohol in public on a certain date - lets say during the olympics - and then dispute it and go to court in the beginning of November and the cop shows up and I lose, but then I find out that the cop was charged with assault in June and has now been suspended at the end of November just two weeks after my court hearing, do I have any chance of appealing my court hearing?
could I argue that his credibility was lacking because of his pending charge? Could I argue that because he is now not an active peace officer that I should have the opportunity for a re-trial? could I argue the point of fairness stating that if someone else received a ticket on the same date as I did but happened to have their court date scheduled for 3 weeks later than me that they would then be able to get the ticket thrown out because he wouldn't show up to court due to being suspended?
I'm just curious about all this... looking for a police officer or a lawyer or someone who knows the court system to give feedback.
