So I was going down 41st avenue and got pulled over near oak street for "following too closely" and was issued a ticket for it. The officer said I should be 3-5 car lengths following distance. I had unknowingly cut off the officer(Unmarked SUV), so he was just lookin to ding me w/ anything. I was probably around a car length away from the car in front of me, who was doing ~55-60km/h.
Under the MVA, S. 162(1) states: Following too closely
162 (1) A driver of a vehicle must not cause or permit the vehicle to follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of the vehicles and the amount and nature of traffic on and the condition of the highway.
It's a pretty bullshit ticket to begin with... but I'm trying to think of ways to dispute it. Seeing how 41st Avenue is not a "highway", do you think I can dispute it based on that?
