I just finished a traffic court date in Penticton yesterday and I figured I’d let people know what took place:
I walked in to the courtroom behind constable Moroshkin who gave me the ticket, he asked my name and he looked it up on his sheet of paper. Then he said, “Oh we couldn’t find a copy of your ticket…” (at which point I was just about to say that I had my copy here with me ) “…so it’ll be thrown out in court,” he continued. So I had a seat and waited for the judge. There were about eight other people with disputes in the courtroom too. Then the judge came in, the constable asked the judge to get the matter of my dispute done first. So I stood up when my name was called. The judge said, “Okay thank you.” I turned to the constable who gave me the ticket and asked if I get some sort of receipt he just said “Nope.” Then the judge said “We’ll handle the paper work.” Thinking to myself that these were the same group of people that lost my ticket to begin with, but I just said okay and left. I never got to make a case of my dispute, which kind of sucked, and it probably cost me more in gas and time away from work than what the ticket was worth ($115) but it did get thrown out regardless of the details.
