As of July 1/03 the police are not required to attend court. Their testimony may be presented by phone call, video conferencing or mail. The accused is still required to attend.
The accused, if pleading guilty to a Motor Vehicle Traffic Act violation will now have the option of a reduced fine if the ticket is paid in a certain time frame.
Expect this to be challenged under the Charter of Rights which guarantees the right to a fair trial. How is the accused supposed to do any effective cross examination of the Crown when testimony is sent by mail or done by phone call?
