When I went to re-insure my car last week I discovered that I owe a large sum of money in fines before I could insure. After several phone calls and a trip to the traffic courts downtown it turns out that I didn't receive my hearing notifications.
And even worse, the reason I didn't receive the notice was because the court location changed from Squamish to North Vancouver and apparently both parties thought that I was notified by the other.
So, of course ICBCs position is they feel this is no fault of theirs and have conveniently pointed the finger at Squamish traffic courts, who have in turn pointed the finger at North Van, who ( yup you guessed it ) point the finger right back at me, claiming something was sent they just don't have a record of it.
After filing an affadavit at the traffic courts I have to wait for approval of a new hearing date from a JP and hope I can win the decision.
BUT in the meantime I had to pay the fines AND points to re-insure my car, and ICBC claims they will re-imburse me if and when the fines are dropped after the JPs ruling.
The one fine occured two and a half years ago and the new court date could take that long as well.
I was told that there have been a number of communication problems with the court location for Whistler offences.
Has anyone else had problems with their dispute/hearing process???
