I went to traffic court this week and was advised that they wouldn't hear the case because the person in the chair isn't actually a judge. i now have another month and a half to wait for the next date with a real judge. all of my paperwork was in but the crown counsel didn't stay the charges prior to trial (as has been done before in a previous dealing i have had in BC)
it will be a 17+ month delay by the next court date since the ticket.
the officer was going to drop the fine to $348.00 if i plead guilty, but said the excessive would stick. so i chose to enter the courtroom and see how it played out, that was when they chose to set a new date.
i can only assume that this will help my cause of a lengthy delay to trial, but am wondering if anyone had made it past this point. as i stated above, it was stayed prior to trial previously, as i expected again. it's a bit of a curveball, and i was advised if the charter argument isn't accepted, be prepared for a trial that day.
