Just thought I'd give a short update on what has happened...
I called in to ICBC to file my claim. She had already filed hers and we were obviously cross referenced. She also had already filed an injury claim and hasn't been to work (ie. called in not feeling well) since the afternoon I told her I wanted an ICBC estimate.
Anyhow, I explained everything to ICBC, about how I felt she was being dishonest, etcetc. and I requested to bring my car for an estimator to look at the "damage" to my car. There are tiny scratches, that you can't even see, unless you crouched down and took a close look.
The estimator confirmed that there was NO WAY, judging from the damage to my car, that her car would need $980 worth of repair.
The adjustor continued to explain to me that they would normaly throw her injury claims out the window right then, but couldn't because she had gotten into an accident 6 days before.
She was making a left turn and got smoked by oncoming traffic. The adjustor said that because she was making a left turn and that she is supposed to yield to oncoming traffic, most likely it will be her fault. BUT, to no one's surprise, she denies it and says it is not her fault, so therefore, they are still currently investigating the case and nothing has been determined. She also made an injury claim in that accident with regards to back and arm pains.
So the injury claims she has in my case are due to "reaggravating previous injuries/back pains from the last accident". Basically, I have to wait for the results of the first claim, before they can determine whether or not her injury claim in my accident is valid. If her injury claim is denied in the previous accident, then mine will be also. If her injury claim is granted, then there is a small possibility that I may have to cover part of it. But after getting the estimate on my car, the adjustor said that that is also very unlikely.
Anyhow, the adjustor asked me specifically explain how I felt she was being dishonest, not only for my claim, but also because she is suspicious in that other claim as well. So I went on to explain how she caused more damage to her car then was originally there; showed her the pictures and how the original damage was like; told her the quote she gave me; explained how she wouldn't let me to take to another autobody..etc...and so on.
Mind you, the adjustor started laughing when I named the place of the autobody she wanted to take it to. The adjustor went on to tell me that all the adjustors know the place well and that some autobodies are known to be "problematic", if you know wut I mean.
Anyway, now I am just waiting for the results from that previous claim. Most likely her injury claim in my case will be denied, because we were going at such low speeds. And an estimator will be looking at the damage to my car and whether or not it could have caused the damage to her car. If they prove that it can't, and that she caused extra damage to her panel herself...shes...basically screwed.
And with regards to insurance, the car is under my mom's name, as she is the primary driver. If ICBC were to pay for the damages, my insurance would go from a 43% discount to a 40% and I would lose roadstar for one year, but would regain the 43% and roadstar the following year if there were no accidents in that period of time...
Since that 3% is only like.....60-70bux?--at most...It's probably best to just let ICBC pay for it.
