So iget this ticket for not coming to a complete stop at a stop sign. Does anyone know about the actual regulations for coming to a stop sign. Yes, I came to a stop, quick point of balance and then back on the gas. The cop was not even in his car at the time but says that he's got me on video tape too. I did stop to a point of balance, but did not put down my foot in which I was not aware of for "regulatory stop." Personally I think he had nothing better to do but if anyone has any knowledge or advice it would be greatly appreciated.

At a stop sign/red light, you are supposed to have your vehicle/bike come to a complete stop, look, and continue when clear. Rolling stops are not considered to be safe and an adequate stop.
On a bike your foot has to touch the ground when at a complete stop.

But everyone does it through stop signs and red lights when making a right hand turn.

From what I know (actually a friend got into the exact situation as yours and got a ticket that why i know some) you have to come to a complete stop when you are at a stop sign. What you did is called a rolling stop, which means you didnt stop comletely and thats why you got the ticket.

To my friends benefit this happened 2 in the morning, pitch black no video so he took it to court and the cop just couldnt prove to the judge that from his distance that he was able to see him stop completely at the sign(it was realy dark).

Didn't you have to take a class 6 road test? Foot has to touch the ground or it is considered a rolling stop and is ticketable. Sucks I know. Has happened to a buddy of mine and he has a trials backround. He can balance anything but the judge didn't care.

dispute it anyway

I often come to a complete stop and then pull away without needing to put my foot down. Typically I hold the balance for about 1/4 to 1/2 a second and then go.

I suspect he didn't see your short stop and balance as cessation of motion.

I have to admit that when I see cop cars around I'll make my stops more deliberate and put a foot down just to avoid moments of judgement such as this one.

Cop is likely lying. I haven't seen a cop car in 10+ years with video in BC. It's too incriminating (for cops), when they beat down folks and harass and the like.

It should be mandatory for them though.

Fight it. Your bike stalled when you started didn't it? U must have stopped.

wow you know a lot. here you slam cops who must be lying, and you offer up defences to the offence which are a lie. you rock.

delta police have cameras. i'm not sure about other jurisdictions, vancouver doesn't.

Easy. Deflate your tires moderately and shoot a video of you coming to a complete stop without putting your foot down. With deflated tires (stunter style) you should be able to hold position without moving or dropping your foot for at least a second.

Take your video to court.

Also in cross examination make sure that the cop testifies that you didn't drop your foot before you enter your evidence.

I'm a regular Matlock, I tells ya.

you prob didnt actually stop moving ,but you can come to a complete stop on a bike without putting your foot down ,people do it all the time .

id ask to see the video and if he doesnt have one ,bring it up with the judge that he indicated he had evidence on camera ,try and catch him in a lie .UNless of course he does have you on camera and you did roll through . that would suck a bit

A certain Vancouver traffic vehicle and motorcycle have video cameras. The motorcycle one can pull up over a minute of footage prior to emerg lights being activated.

Well, here's the question. Did you come to a complete stop? If you challenge in court and the cop does have video, your toast. The judge (or JP) can INCREASE your fine if he wants. If your guilty, just pay the fine.

He wasnt in the car and he GOT YOU ON VIDEO? Was his car aimed directly at the intersection inquestion that you supposedly didnt stop for ? Otherwise I call bullshit on that one , unless its something new where they have remote cameras somewhere else.

:cool We all know what a 'Stop' sign means and yet we all do the 'rolling stop' thing, whether on our bikes or in our cars. If we get ticketed from time to time, just divide the cost of that ticket into the number of times I/you have done a rolling stop; the real cost of a 'rolling stop' likely works out to be less than a penny per offense in the grand scheme of things. ;)

the JP cannot increase your fine for excercising YOUR RIGHT to be heard in court. A Supreme Court decision was clear on this.

I hope that wasn't too cop bashing for anyone.

I had a friend from California convince the cop that it's OK to stop that way in Cali so that's why he did it up here. He didn't get the ticket, but you'd probably need tags and you license from down south to really sell the deal.

;) My point was simply: we all do it. No biggy. Whether somebody wants to dispute a ticket or blame the officer are a different issue. As for the Supreme Court, luckily I've never bin' there. :p

SkipTkt, the question is whether it's legal to stop without putting your foot down. The original post suggests that the rider did stop, but didn't put a foot down. Nobody has posted anything in the MVA that says he has to.

If the rider is 100% sure that he did indeed come to a full stop, then he should fight it, and definitely ask to see the video evidence.

If the rider isn't 100% sure that he was stopped, he'd better be ready to pay his fine.
