My neighbour just called me, told me his GSXR750 been knocked down by a car today at Broadway. The story was, he parked his bike and went to pickup some sushi, in a couple of minutes time, when he came out he saw his bike was tipped over to the right side and the car front bumper was on top of his wheel. The lady driver deny the fault completely saying the bike tip over itself ! Two witnitess saw what had happen, and two other witnitess was on the lady side. He called cops and of course they won't care for these 'tiny' accident, he proceed to dail-a-claim and since he didn't have full coverage, ICBC won't pay for it unless the lady admit it was her fault. The thing is, the lady had called before my neighbour did and reported everything and denies everything too.

The damage - scratched right side fairing, bended can (hit the curb when the bike fell). Sounds to me roughly $2000 damage maybe (?)

How can a bike tip towards the right side if it was parked with a kick stand ?

What will be my neighbour's options ? Lawyer ? Seems like ICBC careless if people weren't getting full coverage.

I would think that he should call a lawer, you usually get the first visit free due to the fact that you are looking for information such as if he chooses to go with the lawer will he be able to sue ICBC and or the lady for the damages and the cost of the lawers fees because he had to go that route. He should not loose the witnesses numbers and if he goes for a lawer make sure he get one who has experience in ICBC claims. ICBC never does good against lawers because their practice is dreadfully close to illegal. Unless the bike was on a hill and parked the wrong way there is no way it'll fall over by itself unless there is gale force winds of about 140+Kph it ain't going to fall over by itself. ICBC is playing on the fact that;

1) he's young
2) he rides a crotch rocket
3) The ladies witnesses are her friends and are lying through their dentures.

I'll stop at this or I'll go off in a rant about the government and I don't want to do that. So tell him to at least check out the lawer route.

I would say that the lady hit his bike because of the angle that the bike sits on being on the kickstand. Do not wash the bike. There may still be marks on the left side from where her bumper stuck his bike. If the marks are there, document (picture) it and provide it to the adjuster. For a bike to be pushed over like that, there will probably be scratches that match up with her bumper height. Also, have your neighbor also take pictures of the area that show that he wasn't parked on a slope. That is the only way that the bike would have fallen in the opposite direction of the kickstand. As far as friends witnessing things like them, I don't think ICBC will find them creditable because they are just that, friends. If your friends witnesses are complete strangers, I don't think he's got anything to worry about. Talking to a Lawyer still isn't a bad idea though.

I think a visit to the lawyer is a great idea. ICBC does not take an individual seriously, but once they call you and you say, 'I am sorry, I have been instructed to ask you to direct all your questions to my lawyer.'

After a mini van runs a red light and collides with me (AND a Jeep that was beside me in the next lane) ICBC was refusing to pay for my physio and did not want to pay out my bike loan! I talk to a lawyer, and as soon as my adjuster found out, my bike loan was paid out within 2 weeks, and all my bills were covered!

I have heard stories from friends about thing like this. I guess I'm lucky and never really had to deal with them. If it works, do it .
