so today i went down on my shiny bike... just cruzing though stanley park and some knob decides to change lanes infront of me mid-corner... I grabbed a handful of brake, and my bike and brand new jacket/gloves/bucket grabbed a handful of asphalt. sucks... and now ICBC wants to claim it under my insurance becaus there was "no contact" and the tool took off... [email protected][email protected] :2guns I hate stupid drivers who dont want to take responsibility for thier actions... !!!

Queue the responses from a dozen people, who all agree with me. Without a witness, the accident was simply your fault for grabbing too much brake. It sucks, but that's the way it goes. Next time, either avoid being in a car's blind spot in a corner, or just expect them to change lanes on you and slow down.

Unfortunately, Spike is right. Not really a hit an run - no one got hit, just cut off unfortunately. With a 30 km speed limit in the park, and if you were "leaning pretty far", then you may have been speeding too? Sucks and it is an expensive way to learn a lesson - never go too fast through Stanley Pk on a sunny weekend.... too many pre-occupied/distracted tourists.

If the damage isn't too bad, just fix it yourself and don't go through ICBC.

I agree with the above statement...... you were probably speeding and took a chance, unfortunately you got the short end of the stick.

I consider speeding the same as gambling in a casino, sometimes you get away with it sometimes you get fucked.

sorry to say, but you got fucked, now bend over and take it up the tailpipe like a man !!!

PS Sorry pal... you hit a soft spot on me...(no not my dick)....but I have been through shit like this before...don;t take this as a flame because I still love you very much Mr Crashtested...


I say go through insurance…why not. Some fuck face cut you off and fucked you up so you crashed…I don't mind kickin in a couple of bucks from my rates to get u a nice shiny bike again!

whats with all the accusations here? if anyone knows the spot, it is the corner right before prospect point... its a very sharp left going uphill. and no, I wasnt speeding... I got a tix last time I sped through stanley pk.. so i keep it down there... i never said " leaning real far " as though I'm dragging knee, no matter if you're going 30 or 50, you will be leaning no matter what. and my "emergency stopping" is fine thank you... next time you're concentrated on going through a tight corner and someone cuts you off, we'll see what you do.

And therein lies the problem; the perception verses the reality.
If what Falcon tells us is true (I'm not questioning the veracity of his information, but would suggest that it's between him and his insurance company) there doesn't need to be a "hit," or a "run."

It's called "Unidentified Motorist," (hmmm, do I sense a rant coming on?) for a reason. It's a motorist, and it's unidentified.
We've covered this many times in the past, and no doubt many have anecdotal information about "getting cut off," and having witnesses to support it.
There doesn't need to be a collision to have another motorist liable.
In legal terms (I'm not a lawyer), Falcon can argue he took evasive action in "the agony of collision," and it's the actions of that unidentified motorist that caused it.

As always in these kinds of mishaps (no one is dead, or in a wheelchair) I'm delighted the rider is okay.

1. My BCSB# was me counting up the list of names and coming up with that # when I got to my name. I'd say it is +/- more then a few # since many have joined/left/been banned since I joined. It has nothing to do with my ability as a rider what so ever.

2. I myself have NEVER claimed any of my self-involved accidents with ICBC, I sucked it up, ate the cost and carried on.

3. What is the posted speed limit in Stanley Park? I'm thinking it's 30km/hr though it could be 50km/hr. At either of those speeds you should be able to take emergency maneuvers. However I wasn't there so I can't say for sure.

4. He called it a 'hit and run' which as he stated there was no contact he just grabbed a handful of brake. I just commented on the refining of his emergency stopping.

5. He is a knob if he claims it and though it won't affect any one of us directly it will be another claim that will bump insurance premiums yet again.

Me neither, but it wasn't out of any misplaced do-gooder "do your part for ICBC's statistics" and, I'm willing to go out on a limb and suggest that it wasn't your motivation either. I've also passed on claiming MANY car breakins and stereo thefts because its been such a hassle that I just didn't want to go through it.

whatever on the speed limit. It is possible (of course) to have another car cause you to have an accident without any contact (and it can be judged 100% not your fault either). The problem is in this case, who knows *exactly* what happened and I think in all our minds the cases where its 50/50 or higher (or avoidable, let's say) are a lot more numerous than the "100% blameless casper-the-car-cut-me-off" situation.

ICBC has actuary's that figure out the rates that they set and that (should) include knobbies poor emergency stopping -- and incidently I believe it is injury claims that really cause the grief. Not to mention that is what insurance is FOR. What do YOU think that freakin expensive collision premium is for? You get the dumbass of the day award for this one.

Glad you're okay...sounds like it may have been a preventable mishap.
